Andrew Klungness

Biography

Andrew is a leading attorney representing clients in novel and complex commercial and intellectual property matters. His clients span a number of verticals, including fintech (digital assets and fiat), consumer products and technology, artificial intelligence, e-commerce, interactive entertainment, and edtech. In particular, Andrew co-leads Fenwick’s consumer technology and digital media teams. Andrew also has extensive experience representing clients in the blockchain and web3 verticals in intellectual property matters, and in this regard serves as a principal member of Fenwick’s industry-leading blockchain team by leading the intellectual property and commercial aspects of the team’s multi-disciplinary practice.

In his legal practice, Andrew leads significant and complex strategic alliances, joint ventures, and other “partnering” arrangements, which are often driven by a combination of technological innovation, industry disruption, and rights to content, brands, or celebrity personas. He also structures and negotiates a wide range of commercial agreements, including licensing, NFT collaborations, technology sourcing, blockchain network, manufacturing and supply, channel partnership, and marketing agreements. Additionally, Andrew provides strategic counseling regarding best practices to develop, protect and monetize IP; navigate the “grey areas” of the law inevitably present in innovation and disruption; and manage technology, IP, and commercial issues in financing, M&A, and other corporate transactions.

Andrew serves clients across the country and around the world, but he is an enthusiastic member of the LA tech community, having practiced technology law in Santa Monica since the “dot com” era.
