Voluntary Carbon Markets
For buyers of carbon credits, this discussion will cover relevant legal and business issues, beginning with a summary of the business and (non-binding) regulatory landscape, including competition in sustainability, the Paris Agreement, SEC Proposed Climate Rules, and the recent comment periods for VCMI & ICVCM industry guidelines. Then, a deep dive on value-maximizing considerations surrounding quality (certification, additionality, permanence, measurement/reporting/verification, double-counting, social harms) and risk mitigation (diversification, insurance, stakeholder communication), with recommendations on how to appropriately perform exacting due diligence given the various market participants and their incentives, which may be aligned or misaligned with buyers. Finally, panelists will discuss emergent legal & business issues, including jurisdictional vs. project-level approaches to crediting, transferability (and equity of value capture), and tokenization.
